1. Introduction
The following General Terms and Conditions of Sale govern the offer and sale of products on the website www.fratellidesideri.com (“Website”) between FRATELLI DESIDERI SRL, VAT No. 03737940043, REA CN Number 313170 (hereinafter: “Fratelli Desideri Srl” or “Company”) – and the end consumer (hereinafter: “Customer”).
2. General Information
2.1 As a result of orders placed by the Customer and duly received and accepted by the Company under this contract, “Fratelli Desideri Srl” transfers or undertakes to transfer ownership of said goods to the Customer, and the Customer pays or undertakes to pay the price thereof.

2.2 The products available for purchase are presented on the website, via email, in print or electronic catalogs, by mail, or by telephone. “Fratelli Desideri Srl” serves the end consumer, who receives the products for sale. Customers with a VAT number who wish to receive an invoice must request one by providing all necessary information at the time of ordering.
E-commerce activities are intended exclusively for adult end users. Therefore, to proceed with the purchase, you must declare that you are of legal age.
The products remain the property of “Fratelli Desideri Srl” until the customer has paid the purchase price, any shipping costs, and any other additional charges, as indicated in the purchase order and in accordance with the procedures set forth in the following section.
3. How to Order – Sales Contract
3.1 The order may be placed through the channels indicated in point 2.2 above
3.2 Specifically, when using the Website, the customer selects the products or offers, which are automatically added to the shopping cart. To confirm their purchases, the customer accesses the shopping cart section by clicking the “shopping cart” button and fills out the order form that appears on the screen, the contents of which (products or errors) can be modified by the customer at any time before the order is finalized. Along with the contents of the shopping cart, the customer will see the total amount due, which will be automatically updated if the customer changes the selected products or quantities.
3.3 By clicking the corresponding button, the customer will proceed and fill out the form with the necessary information for billing (if requested), payment, and delivery.
Before final confirmation, the shopping cart will be displayed again with the total amount due.
3.4 The sales contract shall be deemed concluded only when the customer has accepted the terms and conditions of sale set forth in the contract by clicking the “PLACE ORDER” button. If the customer does not confirm acceptance of the sales contract by clicking the “PLACE ORDER” button, the sales contract shall not be deemed to have been successfully concluded. No payment will be due, and the customer will not receive the selected products. “Fratelli Desideri Srl” will send the customer an email summarizing the order and its status, in accordance with Article 13 of Legislative Decree 70/2003, containing the following information: a summary of the general and specific terms and conditions applicable to the contract, information regarding the essential characteristics of the goods or services, a detailed indication of the price and payment methods, and a detailed indication of the right of withdrawal, delivery costs, and applicable taxes.
3.5 If the product presented on the website is no longer available or for sale after the purchase order has been submitted and payment made, “Fratelli Desideri Srl” will promptly notify the customer of the product’s unavailability and will contact the customer to agree on an alternative:
replacement with another product of equal value, upon submission of the duly signed “replacement confirmation” form; or a refund of the price paid, which “Fratelli Desideri Srl” will process within 5 (five) days.
It is not possible to replace the purchased product with another at no additional cost.
3.6 In the case of promotional offers, the customer may purchase one or more individual offers.
4. Product descriptions, features, and prices
4.1 Products are presented and described on the website, in specific online offers, and in sales emails that may contain specific links.
4.2 The expiration date of each meal kit is indicated on the respective product page. By making a purchase, the customer agrees to consume the item by the specified date.
4.3 The prices of the goods presented are expressed in euros and include VAT. The duration of any promotions and offers is indicated next to the product or offer to which it refers, as are the applicable prices.
4.4 Exclusive offers or “flash sales” for products published on the website or sent via email are of limited duration, as always indicated, and are valid while supplies last. The expiration date of the offers is indicated on the website and communicated to registered customers.
4.5 The prices of our products are subject to change without notice.
We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time.
4.6 Any additional charges, where applicable, are indicated next to the product to which they apply.
4.7 If an item included in a promotional offer is out of stock, it will be replaced with an alternative item of the same value; if an entire package or the majority of the ordered products are out of stock, “Fratelli Desideri Srl” will contact the customer.
4.8 10% First-Time Registration Discount: Upon initial registration, each user will receive a 10% discount code, valid on the first purchase of any product category listed on the site, with the exception of “Regala una Cena” gift cards.
5. Shipping Costs
5.1 A shipping fee is required, and the amount varies depending on the number of boxes, the weight, or the destination of the goods. The shipping cost is always indicated and visible during the checkout process.
5.2 Shipping costs may be waived for orders exceeding a predetermined cart value, which may be modified without notice at any time. This value is displayed on the website. If payment for the products is made via gift card or voucher, shipping costs are always due.
5.3 Shipping costs and any other additional charges, including VAT and expressed in Euros (€), will be explicitly and separately indicated on the order form before the User submits it, as well as in the order confirmation email sent by “Fratelli Desideri Srl”. The price of the products published on the Site may be modified without prior notice, provided that the price charged to the User will be the one indicated on the product page at the time the User submits the order.
5.4 For bulky packages or goods of particular value, a packaging fee may be required. The amount of this fee varies depending on the product to be delivered and is clearly indicated in the documentation—whether paper or electronic—used to complete the order.
6. Payment Methods
6.1 The following are accepted: PayPal and major credit card networks.
6.2 Please note that “Fratelli Desideri Srl” will not impose on Customers, in relation to the aforementioned payment cards, any fees for their use, or, in cases expressly established and communicated, rates exceeding those incurred by “Fratelli Desideri Srl” itself. The payment card issuer will refund the Customer for any payments in the event of an overcharge relative to the agreed price or in the event of fraudulent use of the payment card by “Fratelli Desideri Srl” or a third party. The payment card issuer has the right to charge “Fratelli Desideri Srl” for the amounts credited back to the customer.
6.3 If, for any reason, the customer’s payment is declined, “Fratelli Desideri Srl” will reject the customer’s purchase order and notify the customer via email.
6.4 The amount due, as specified in the purchase order sent by the customer and accepted by “Fratelli Desideri Srl,” will be charged at the end of the purchase process only after verification of the credit card details used by the customer and authorization of the charge by the issuer of the credit card used by the customer.
7. Delivery Terms and Liability
7.1 The order fulfillment process is handled with care and takes time. “Fratelli Desideri Srl” undertakes to deliver the ordered goods within 2–3 (two to three) business days for central and northern Italy, 4 (four) business days for southern Italy and the islands, and 8 (eight) business days for deliveries outside Italy, for orders completed with electronic payment (credit card, PayPal).
7.2 The estimated delivery times are, however, indicative and not binding, as deliveries are handled by external couriers operating nationwide (Amazon Shipping, GLS, BRT). “Fratelli Desideri Srl” reserves the right to postpone shipment if the order cannot be shipped for reasons beyond our control. Special promotions or sales may cause shipping delays.
7.3 “Fratelli Desideri Srl” disclaims all liability for any delays in the delivery of goods due to force majeure or unforeseen circumstances (such as increased order volume during holidays, strikes, or natural disasters).
7.4 Items already in stock are shipped within 2–3 business days (Monday through Friday) from the order date.
During sales or promotional periods, shipping may take longer.
7.5 Pre-order items display the availability date on their product page. This date may vary depending on production needs and timelines. Delivery within 2–3 business days is therefore to be understood as starting from the specified date.
7.6 Delivery is considered complete when the ordered goods are received by the customer or by the person designated by the customer to pick them up. If these terms cannot be met (e.g., products not in stock), “Fratelli Desideri Srl” undertakes to notify the customer via the fastest available method to inform them and indicate when the goods can be delivered.
8. Goods Damaged Upon Delivery
8.1 If the courier delivers packages that are damaged, broken, or stained due to product leakage, the customer is required to refuse the shipment, clearly indicating the reason on the courier’s delivery form. “Fratelli Desideri Srl” will arrange for the return of the shipment via the courier.
8.2 If the shipment consists of multiple packages and not all of them are damaged, the customer has the right to refuse delivery and reject only the damaged package, signing the courier’s delivery form “With Reservation” and indicating the number of damaged and returned packages. “Fratelli Desideri Srl” will arrange for the return shipment via the courier, at no additional cost to the customer.
8.3 The damaged product will be replaced by “Fratelli Desideri Srl” at no cost to the customer within 15 (fifteen) business days of delivery. If the product to be replaced is out of stock, the customer will be contacted promptly by “Fratelli Desideri Srl” to arrange, as an alternative, either a replacement with another product of equal value—upon submission of the duly signed “replacement confirmation” form—or a refund of the price paid, which “Fratelli Desideri Srl” will process within 5 (five) business days.
8.4 Shipping costs for returning the damaged package to “Fratelli Desideri Srl,” for redelivering the replacement products to the customer, and any costs associated with refunding the purchase price are borne by “Fratelli Desideri Srl.”
9. Returns and Replacement of Defective Goods
9.1 Should the customer discover a defect in the product or products delivered to them, they are required to promptly notify us via email at ciao@fratellidesideri.com, reporting the issue encountered and specifying their first and last name, order number, and a detailed description of the defect found, attaching supporting photographs, as well as making the product deemed defective available to “Fratelli Desideri Srl”.
9.2 “Fratelli Desideri Srl” will verify the defects reported by the customer; if confirmed, this will entitle the customer to a replacement of the product or products, following notification to the customer’s email address.
9.3 “Fratelli Desideri Srl” will replace the defective product(s) at its own expense and cover the return shipping costs. In the event that the products initially requested by the customer are out of stock, “Fratelli Desideri Srl” will refund the amount paid by the customer as soon as possible and in any case within 3 (three) days of receiving the authorization notice from “Fratelli Desideri Srl”.
9.4 Should the Customer receive a package from the courier that is damaged or stained by product leakage from any damaged boxes, “Fratelli Desideri Srl” asks the Customer to refuse the shipment. In such a case, “Fratelli Desideri Srl” will handle the return of the shipment. All costs associated with returning the damaged package and any subsequent costs for reshipping the product as quickly as possible are, of course, borne by “Fratelli Desideri Srl”.
10. Unsolicited Deliveries
10.1 Unless the Customer gives their consent—which must be provided before or at the time the contract is concluded—“Fratelli Desideri Srl” will not make any delivery other than the one agreed upon, even if it is of equivalent or superior value and quality.
10.2 If the Customer receives an unsolicited delivery, they must notify “Fratelli Desideri Srl” Customer Service, Tel. +39 0171 1876598, so that “Fratelli Desideri Srl” may arrange for the pickup of said delivery and refund the Customer any amount already paid.
11. Right of Withdrawal
Article 52 of Legislative Decree 21/2014 allows the Customer to exercise the right of withdrawal (i.e., the right to return the goods, for any reason and without providing justification and at no cost to the Customer) within 14 (fourteen) days of delivery of the goods. Therefore, the Customer may exercise the right of withdrawal within 14 (fourteen) days of taking possession of the ordered goods, simply by notifying “Fratelli Desideri Srl.” The right of withdrawal may be exercised by submitting any explicit statement of your decision to withdraw from the contract, via email to ciao@fratellidesideri.com; via regular mail to “Fratelli Desideri Srl”, Via Carlo Pacal 7, 12100 – Cuneo – Italy – To the Attention of Fratelli Desideri Customer Service.
The right of withdrawal does NOT apply to orders under 50.00 euros (Article 47, paragraph 2, of the Consumer Code).

12. Exclusion of Liability in Cases of Force Majeure
Under no circumstances shall “Fratelli Desideri Srl” be held liable for the failure to fulfill any of the obligations arising from these General Terms and Conditions of Sale in the event that such failure is caused by unforeseeable circumstances and/or force majeure, including, by way of example only, natural disasters, terrorist acts, network malfunctions, and/or blackouts.
13. Suspension of Service
13.1 “Fratelli Desideri Srl” reserves the right to temporarily suspend, without prior notice, the operation of the Website for the time strictly necessary to perform technical interventions required and/or appropriate to improve the quality of the services offered.
13.2 “Fratelli Desideri Srl” may, at any time, suspend the User’s access to the service offered on the Website if there are valid reasons (related to security, breaches of confidentiality, or improper use of the Website), in which case it shall promptly notify the User.
14. Legal Warranty
14.1 Items and accessories that may accompany the offers are warranted for 2 (two) years against any manufacturing or operational defects. Damage resulting from wear and tear, improper use, or improper maintenance is excluded from the warranty.
14.2 The legal warranty of conformity protects the Customer in the event of the purchase of defective products, products that malfunction, or products that do not meet the intended use as stated by “Fratelli Desideri Srl” or the manufacturer of the goods, or the use for which the goods are generally intended. The Customer may assert their rights under the legal warranty of conformity by contacting the manufacturer of the goods directly, even if different from “Fratelli Desideri Srl.” In the event of a lack of conformity, the Customer is entitled, at their discretion, to the repair or replacement of the defective goods, free of charge, unless the requested remedy is impossible or excessively burdensome compared to the other. If replacement or repair is not possible, the Customer is still entitled to a price reduction or a refund, commensurate with the value of the product, upon returning the defective product to “Fratelli Desideri Srl.” The legal warranty lasts for 2 (two) years from the delivery of the product and must be claimed by the Customer within 2 (two) months of discovering the defect.
15. Jurisdiction
For any civil dispute between “Fratelli Desideri Srl” and the Customer arising from the interpretation of the regulations and the terms and conditions set forth herein, the Court of Cuneo shall have jurisdiction.
16. Closing Provisions
16.1 These General Terms and Conditions of Sale are governed by Italian law and, in particular, by Legislative Decree No. 206 of September 6, 2005, on the Consumer Code, with specific reference to the regulations governing distance contracts, and by Legislative Decree No. 70 of April 9, 2003, concerning electronic commerce, where applicable.
16.2 The General Terms and Conditions of Sale may be periodically amended in accordance with market developments, as well as to comply with any legislative updates or changes. Any updates or changes will be regularly published on the Website, and “Fratelli Desideri Srl” encourages the customer to periodically review such updates and changes.
